As a client, you can submit termination requests through the termination wizard on the Native Teams platform. This will ensure a structured and efficient process where:
- The termination is reviewed to ensure legal compliance.
- Our legal team, customer lifecycle team, and your designated point of contact will supervise the process.
By using this system, you can rest assured that the termination is handled professionally, legally, and with minimal disruptions.
Notifying Native Teams
To initiate an employment contract termination, you must notify Native Teams at least 30 days in advance. This period is separate from any notice period required for the employee and gives us the necessary time to handle the process in compliance with local regulations.
Before proceeding, you should review the employee’s contract to understand key terms like notice period, severance obligations, probation causes, and other termination-related conditions. It’s also important to determine the type of termination, whether voluntary (resignation, retirement) or involuntary (due to performance issues, misconduct, or redundancy) if you want to end a fixed-term contract.
If there are any uncertainties, our team is always available to provide guidance on the applicable regulations in each country.
Compliance with notice period and leave balances
As an employer, you must comply with the mandatory notice period outlined in the employment contract as well as the local law. In some cases, the notice period may need to be adjusted to align with the relevant legal requirements.
To ensure accurate final compensation calculations, you should regularly update Native Teams on your employees’ annual leave balances. This will help us properly account for any outstanding leave for the final payout.
The timing of the termination should also be carefully considered to avoid unintended financial obligations, such as additional bonuses or severance triggers.
Documentation and termination process
For terminations due to performance issues or misconduct, you must provide relevant documentation, such as performance records, disciplinary actions, or prior warnings. Native Teams will prepare the official termination letters and ensure that they include all the necessary legal details, such as the reason for termination, final working date, and severance or final compensation.
Some jurisdictions may require formal consultation with the employee before termination. If this applies, our team will advise on how to proceed.
Final compensation and benefits
Native Teams will manage all the final salary payments, severance calculations, and accrued leave payouts while making sure that everything is compliant with local laws. We will also oversee the termination of benefits, including health insurance, pension contributions, and social security obligations.
Legal compliance and employer obligations
Since Native Teams is the legal employer, we’re responsible for supervising the entire termination process. You, as a client, shouldn’t inform the employee about the termination before consulting with Native Teams to avoid creating compliance risks by independent actions.
Native Teams will review the termination request and, if necessary, advise on adjustments to ensure compliance with country-specific labour laws. In cases where the requested termination doesn’t meet the local legal standards, we may require modifications to ensure a lawful process.
Post-termination procedures
After termination of the employment contract, Native Teams will:
- Handle statutory reporting to tax and social authorities.
- Issue employment certificates if required by local regulations.
- Provide the necessary documentation to confirm the termination of benefits.
If a termination is disputed, our team will assist in resolving the issue through mediation or legal support.
As a client, you also have the option to downgrade the employee’s seat to another plan if you want to continue working with them under a different arrangement. For more details about our pricing plans, please visit our pricing page.
