Ending an EOR contract through Native Teams is a structured process that you must follow to ensure compliance and avoid legal risks. Below are the legal obligations that you must consider:
Notifying Native Teams
To initiate contract termination, you must inform Native Teams at least 30 days in advance. This period is separate from any notice period required for the employee and gives us the necessary time to handle the termination in line with local labour laws.
Reviewing contract terms
Before proceeding with termination, it’s essential to review the employee’s contract and understand the key conditions, such as:
- Notice period requirements
- Severance pay obligations
- Probationary terms
- Any country-specific termination rules
Compliance with notice period and leave balances
As an employer, you must comply with the notice period agreed-upon in the employment contract, as well as the requirements set by local labour laws. In some cases, the notice period may need to be adjusted to align with legal requirements.
To ensure accurate final compensation, it’s essential to keep Native Teams regularly updated on your employees’ leave balances. This will help us correctly calculate any remaining payouts for unused leave.
Providing required documentation
If the termination is due to performance issues or misconduct, you must provide supporting documentation, such as:
- Performance records
- Disciplinary action
- Prior warnings
Based on the provided documentation, Native Teams will prepare the official termination letter with all the necessary legal details, such as the termination reason, final working date, and any severance or final compensation.
Final compensation and benefits
Native Teams will handle all final salary payments, severance calculations, and accrued leave payouts to ensure compliance with the employee’s local laws. We will also handle the termination of benefits, including health insurance, pension contributions, and social security obligations.
Legal employer obligations
Since Native Teams is the legal employer of the terminated employee, we will supervise the entire termination process to ensure that everything complies with local regulations. You should not notify the employee about the termination before consulting with Native Teams, as independent actions could create legal risks and issues.
Post-termination procedures and obligations
After the employment contract is terminated, Native Teams will:
- Handle mandatory reporting to tax and social authorities
- Issues employment certificates if required
- Provide the necessary documentation to confirm the termination of benefits.
If the termination is disputed, our team will assist in mediation or legal support.
